Answer: A Doctor can dispense medicines under the following five laws of the land :- 

(a) Section 27 of Indian Medical Council Act, 1956.

(b) Rule 6.3 of Indian Medical Council (Professional Conduct, Etiquette and Ethics) Regulations, 2002.

(c) Rule 3.7.1 of Indian Medical Council (Professional Conduct, Etiquette and Ethics) Regulations, 2002.

(d) The Pharmacy Act, 1948, Sec.42.

(e) Drugs & Cosmetics Rules, 1945 Schedule K Item No. 5 (under Drugs & Cosmetics Act, 1940).

Explanation:-

(a) Indian Medical Council Act, 1956, Section 27: Privileges of persons who are enrolled on the Indian medical register: Subject to the conditions and restrictions laid down in this Act, regarding medical practice by persons possessing certain recognised medical qualifications, every person whose name is for the time being borne on the Indian Medical Register shall be entitled according to his qualifications to practice as a medical practitioner in any part of India and to recover in due course of law in respect of such practice any expenses, charges in respect of medicaments or other appliances, or any fees to which he may be entitled.

(b) IMC Ethics Regulations, 2002, Regulation 6.3: Running an open shop (Dispensing of Drugs and Appliances by Physicians):- A physician should not run an open shop for sale of medicine for dispensing prescriptions prescribed by doctors other than himself or for sale of medical or surgical appliances. It is not unethical for a physician to prescribe or supply drugs, remedies or appliances as long as there is no exploitation of the patient. Drugs prescribed by a physician or brought from the market for a patient should explicitly state the proprietary formulae as well as generic name of the drug.

(c) IMC Ethics Regulations, 2002, Regulation 3.7.1: A physician shall clearly display his fees and other charges on the board of his chamber and/or the hospitals he is visiting. Prescription should also make clear if the Physician himself dispensed any medicine.

(d) Pharmacy act 1948, Chapter 5, Section 42: Dispensing by unregistered persons:-

(1) On or after such date as the State Government may by notification in the Official Gazette appoint in this behalf, no person other than a registered pharmacist shall compound, prepare, mix, or dispense any medicine on the prescription of a medical practitioner; Provided that this sub-section shall not apply to dispensing by a medical practitioner of medicine for his own patients, or with the general or special sanction of the State Government, for the patients of another medical practitioner.

(2) Whoever contravenes the provisions of sub-section (1) shall be punishable with imprisonment for a term which may extend to six months, or with fine not exceeding one thousand rupees or with both. 

(e) Drugs & Cosmetics Rules, 1945 (Under Drugs & Cosmetics Act, 1940), Schedule K, Item 5:

Class of Drugs- Drugs supplied by a registered medical practitioner to his own patient or any drug specified in Schedule C supplied by a registered medical practitioner at the request of another such practitioner if it is specially prepared with reference to the condition and for the use of an individual patient provided the registered medical practitioner is not (a) keeping an open shop or (b) selling across the counter or (c) engaged in the importation, manufacture, distribution or sale of drugs in India to a degree which render him liable to the provisions of Chapter IV of the Act and the rules thereunder. (Extent and Conditions of Exemption- All the provisions of Chapter IV of the Drugs & Cosmetics Act and the Rules made thereunder, subject to certain conditions.

Dispensing of drugs by dr is valid till patient is not exploited. What is the definition of patient exploitation? Getting medicines and vaccines at 60-70% discount and charging MRP to patient is not exploitation? Prescribing medicines not required at all to fulfill Pharma companies commitments is not exploitation. Now a days dispensing drs are earning more than the manufacturer of drug.

Continuation, when the same patient applied for reimbursement as pt is eligible for 90 percent out of 5 Ls, the health scheme pays only 40 percent and they don't have courtesy to reply even after many requests. No ethics even from colleagues.

Every product sold everywhere carries a margin. We do not know them that's all. Depending on the number of middle men they are distrubuted. Nothing wrong in cutting out the middle person and taking the profit from it. As long as it's indicated for the patients benefit. No person sells their wares below prescribed Mrp. Hence no need to feel guilty about it. No one shaves off the margin while providing goods for us.

1.Dr can dispense medicine to his own patient...and not sell in an open shop..( but most of the docters purchasing from mgr and sell in huge profit...most of them not disclose as this a income and not registered with GST.. 2 Patient (consumer have a right to choose where to buy medicines and what company medicine...).
